Where patentees find the act of patent infringement, they may resort to the local intellectual property office (Shanghai Free trade zone Intellectual Property office or Pudong district intellectual office) to which the infringer belongs for administrative proceedings or they may appeal to Shanghai Intellectual Property court to which the infringer belongs or where infringement happens.
Where disputes arise from the division of patent right, right of patent application, remuneration to inventor of service invention, etc, patentees may request the local intellectual property office for intermediation or appeal to people’s court.
